Terms of Use

1. Definitions

• Platform / Service : the online service "BikeFit IA" accessible at bikefit-ia.com
• Publisher : PWA-TECH — Christophe Bonzom, Publisher of the Platform
• User : Any person holding a free BikeFit IA account, without a paid Subscription.
• Account : personal space associated with login credentials providing access to the features
• Content : any video submitted by the User through the Platform
• Analysis : algorithmic/AI processing of Content producing results (angles, scores, recommendations)
• Report : document (e.g., PDF) generated from an Analysis
• Pose Data : skeleton coordinates (2D keypoints) and joint angles extracted from a video

2. Purpose and Scope

These Terms of Use govern access to and use of the BikeFit IA Platform.

Publisher : PWA-TECH — Christophe Bonzom, Publisher. Full legal notices (legal form, address, registration, hosting provider) are available on the Legal Notices page, accessible at all times from the website footer.

Accessibility : The Service is intended for users residing in the European Economic Area (EEA) and Switzerland. The Publisher does not actively market the Service in the United States or Canada. Users accessing the Service from these territories do so on their own initiative. The Publisher does not guarantee the compliance of the Service with the regulations applicable in these countries and disclaims any liability resulting from use that does not conform to the geographic destination of the Service. The Service is governed by French law. Any dispute falls under the exclusive jurisdiction of the French courts.

3. Acceptance of the Terms of Use

By accessing the Platform and/or creating an Account, the User acknowledges having read, understood and unconditionally accepted these Terms of Use.

If you do not accept these Terms of Use, you will not be able to create an Account or access the Service.

4. Description of Services

BikeFit IA offers the following services:

• AI-powered biomechanical analysis of cycling position
• Personalized position adjustment recommendations
• Score calculation (Position, Aerodynamics, Comfort, Efficiency)
• Detailed PDF report export
• Saved analysis history
• AI Coach with personalized analysis

The exact features may vary depending on the subscribed plan and may evolve over time.

5. Plans, Trial and Subscription

5.1 Plans

• Free account : 1 free analysis without a credit card
• Paid plans : Expert Plan (€19.99/month, 10 analyses/day, 1 device) and Pro Plan (€49.99/month, unlimited analyses, 2 devices). Automatic renewal, cancellable anytime.

Once the free analyses are used up : access to new analyses is blocked. The User retains access to their history and can subscribe to the Expert or Pro Plan.

The applicable prices and plan details are those displayed on the Pricing page at the time of purchase.

5.2 Renewal

Expert and Pro subscriptions are automatically renewed each month. The User can cancel the automatic renewal at any time from their profile. After cancellation, access is maintained until the end of the paid period. Detailed terms are available in the General Terms of Sale.

5.3 Fair use

Each plan has defined usage limits (number of analyses per day), which can be found on the Pricing page. Beyond these technical limits, the Service is subject to a fair use policy designed to prevent: automation, account sharing, resource abuse, or behavior degrading the Service.

In the event of detected abnormal usage, the Publisher will apply the following procedure:

1. Warning : email notification describing the behavior in question
2. Temporary limitation : reduction of features if the behavior persists
3. Suspension : Account suspension in accordance with Section 10

In cases of manifest fraud, unlawful activity, security risk, abusive automation, account sharing, or attempted technical circumvention, the Publisher may suspend the Account immediately, without prior notice.

6. Registration, Account and Eligibility

6.1 Account Creation

The User undertakes to provide accurate information and to keep it up to date. The User is solely responsible for the confidentiality of their login credentials.

In the event of a suspected compromise of your login credentials, you must notify us immediately and change your password.

6.2 Minimum age

The Service is accessible to persons aged 16 and over. Minors aged 16 to 17 must have the authorisation of a holder of parental authority.

Registration by a minor aged 16 to 17 constitutes a declaration that they have obtained the required parental authorisation. The Seller reserves the right to request proof of such authorisation.

7. Rules of Use

7.1 Authorized use

The Service may be used:

• for personal use
• by cycling professionals (e.g., bike fitters, coaches) to assist their clients, subject to compliance with these Terms of Use

Professionals may share generated Reports with their clients as part of an individual consultation.

Professional use with clients : If a professional uploads a video of a client, they warrant that they have informed that client, obtained the necessary authorizations (including image rights), and have an appropriate GDPR legal basis for such processing.

7.2 Prohibited activities

The following activities are prohibited:

• using the Service for unlawful purposes
• circumventing technical limitations or disrupting the Service
• using bots or unauthorized automation
• attempting to reverse-engineer the AI algorithms
• sharing, renting or reselling access to the Account
• offering the Service as a "white label" product or integrating it into a third-party service without written consent
• publishing or distributing Reports for mass resale or commercial distribution
• uploading Content that is illegal, violent, or infringes upon the rights of third parties
• creating multiple Accounts for the same individual, in particular to benefit from the free trial offer more than once

7.3 Device Limitation

The number of authorised devices per Account varies depending on the subscribed plan: one (1) device for the Free plan, one (1) device for the Expert plan, two (2) devices for the Pro plan. Any attempt to use the Service beyond this limit will be refused. Devices are identified by a unique identifier (cookie) assigned to each browser. Upon account creation, SMS verification is required to ensure account uniqueness. The phone number is never stored in plain text: only a cryptographic hash (HMAC-SHA-256) is retained.

7.4 Abuse Detection

The Publisher implements technical measures to detect abuse and fraud, in accordance with its legitimate interest (Art. 6.1.f GDPR). Upon detection of fraudulent behaviour (multiple accounts, account sharing, circumvention of limitations), the Publisher reserves the right to suspend or delete the Accounts concerned without notice or refund.

8. Uploaded Content – User Obligations

The User warrants that they:

• hold all necessary rights and authorizations over the Content submitted (including image rights if third parties appear in the video)
• submit only Content necessary for the use of the Service
• do not record medical information, confidential documents, or unnecessary sensitive data

The Publisher reserves the right to remove any manifestly unlawful Content and to take the measures set out in Section 10.

9. Billing and Payment

9.1 Pricing

Prices are displayed in euros on the Pricing page. The Expert plan provides one month of access.

VAT not applicable, Article 293 B of the French General Tax Code.

Payments are made in euros. For users outside the eurozone, currency conversion is handled by the payment provider at the prevailing exchange rate.

9.2 Cancellation by the User

The User may cancel their subscription at any time from their dashboard. Access remains active until the end of the current period.

If automatic renewal is enabled, the User may disable it at any time.

9.3 Right of withdrawal

Withdrawal conditions are detailed in our General Terms of Sale.

10. Suspension – Termination – Account Deletion

10.1 Suspension by the Publisher

The Publisher may suspend or restrict access to the Account in the event of:

• breach of the Terms of Use
• abnormal or abusive usage (following the procedure set out in Section 5.3, except in serious cases)
• security risk
• fraud or unlawful activity

Except in cases of security emergency, manifest fraud, or unlawful activity, the User will be notified by email and given a reasonable period to provide an explanation.

10.2 Termination by the User

The User may delete their Account at any time from their personal space (My Account).

10.3 Consequences

Upon Account deletion:

• access to the Service is immediately terminated
• saved Analyses are deleted within 30 days, unless a prior export request has been made or a legal retention obligation applies

Legal exceptions : billing data (invoices, payment history) is retained in accordance with accounting and tax obligations (10 years).

11. Intellectual Property – Licenses

11.1 Rights of the Publisher

The Platform, its interface, content, distinctive signs and algorithms are protected and remain the property of the Publisher.

11.2 User's rights over their Content

The User retains ownership of their Content (videos). The User grants the Publisher a non-exclusive license, limited to the processing period, for the sole purpose of generating the Analysis.

Video deletion : Source videos are automatically deleted within a maximum of five (5) minutes after processing is complete, a period required for the secure transfer of analysis results. No video is retained beyond this period.

11.3 Pose Data and Service improvement

Only Pose Data (skeleton, angles) from Analyses saved by the User may be pseudonymized and/or anonymized and used to improve the Service, in accordance with the Privacy Policy.

Such data is not intended to identify the User and is subject to the minimization and security measures described in the Privacy Policy.

11.4 License on Reports

The User is granted a personal right of use over generated Reports, including:

• personal use
• sharing with a professional (bike fitter, coach, physician) for consultation purposes
• for professionals: providing the Report to a client and internal use as part of a consultation (archiving, monitoring, comparison)

Any mass resale, commercial distribution, or "white label" use is prohibited without written consent.

12. Data Protection

The processing of personal data is governed by our Privacy Policy, in compliance with the GDPR. The Privacy Policy forms an integral part of these Terms of Use.

Privacy by Design : Videos are automatically deleted within a maximum of five (5) minutes after processing is complete. Pose Data is retained only if the User saves their Analysis.

Retention periods, purposes, legal bases, processors, and rights (access, rectification, erasure, objection, portability) are detailed in the Privacy Policy.

13. Liability and Warranties

13.1 Disclaimer – Non-medical recommendations

BikeFit IA Analyses are AI-based recommendations and do not constitute medical advice.

The User is responsible for their application and should consult a healthcare professional in cases of persistent pain, known medical conditions, or pre-existing pathologies.

13.2 Limitation of Liability

The Publisher does not guarantee that Analyses are free from errors and shall not be held liable for any consequences resulting from the User's application of the recommendations.

To the extent permitted by applicable law, the Publisher shall not be liable for indirect damages (data loss, loss of profit, reputational harm).

Nothing in these Terms of Use limits liability that cannot be excluded by law (gross negligence, willful misconduct, statutory obligations).

The total liability of the Publisher, from all causes combined, is limited to the amounts actually paid by the User during the preceding 12 months.

14. Service Availability

The Publisher endeavors to ensure optimal Service availability. Interruptions may occur due to:

• scheduled maintenance (with prior notice where possible)
• technical reasons beyond our control (hosting provider, network)

No compensation is owed for occasional or short-duration interruptions. In the event of significant downtime attributable to the Service, the Publisher may grant a pro-rata extension or service credit, as described in the General Terms of Sale.

15. Force Majeure

The Publisher shall not be held liable for failure to perform its obligations in the event of force majeure as defined under French law, including but not limited to: natural disasters, widespread power or internet outages, acts of war, government decisions, or major unavailability of technical service providers.

16. Amendments to the Terms of Use

The Publisher may amend these Terms of Use. Amendments will be published on this page with the updated date.

In the event of a substantial amendment (pricing, rights, liability), the User will be notified by email and asked to accept the new Terms of Use upon their next login. In the event of refusal, the User may cease using the Service and cancel their subscription in accordance with the General Terms of Sale.

For minor amendments, continued use of the Service constitutes acceptance.

17. Governing Law and Disputes

These Terms of Use are governed by French law, subject to the mandatory provisions from which the User benefits in their country of residence.

Language : These Terms of Use are available in multiple languages. In the event of any discrepancy between the different language versions, the French version shall prevail.

In the event of a dispute, the User may seek mediation in accordance with the French Consumer Code. The terms and conditions are set out in the General Terms of Sale.

Failing amicable resolution, the French courts shall have jurisdiction, subject to applicable consumer protection rules.
