1. Definitions and Purpose
These General Terms of Sale (hereinafter "GTS") govern all contractual relationships between the Seller and the Client regarding the subscription to and use of the BikeFit IA service. They are accessible at any time on the website and prevail over any other document.
Definitions
- Seller: PWA-TECH — Christophe Bonzom, Publisher, SIRET 999 005 911 00014, 200 rue de la Croix Nivert, 75015 Paris, France.
- Client: Any natural or legal person subscribing to a BikeFit IA plan for personal or professional use.
- User: Any person holding a free BikeFit IA account, without a paid Subscription.
- Services: All video-based biomechanical analysis, diagnostic, and recommendation features provided by the BikeFit IA platform.
- Subscription: A paid subscription plan granting access to the Services for a specified period.
2. Plans and Pricing
2.1 Plans and pricing
BikeFit IA offers a free plan (1 analysis) and paid Expert and Pro subscriptions. The details of each plan, its features and the prices in force are available on the Pricing page, which prevails. The applicable prices are those displayed at the time of subscription. Prices are in euros; VAT not applicable (article 293 B of the French Tax Code).
2.2 Free offer
Upon account creation, the User receives 1 free analysis with no time limit. No payment method is required. Once the free analysis is used, the User can subscribe to an Expert or Pro plan.
3. Ordering and Subscription
3.1 Registration

- Accept these General Terms of Sale, the Terms of Use and the Privacy Policy
- Immediate access to the free analysis (1 analysis)
Subscribing to an Expert or Pro plan
- Choose a plan from your account dashboard
- Enter payment information (securely processed by Stripe)
- Order confirmation and receipt of a confirmation email
3.2 Access conditions
To create an account and access the Services, the User must:
- Be at least 16 years old (or have the authorization of a legal guardian)
- Provide accurate and complete information during registration
- Accept these General Terms of Sale, the Terms of Use and the Privacy Policy
3.3 Duration and renewal
The subscription gives access to the Services for a period of one month from the subscription date. It is then automatically renewed for successive one-month periods, at the price in force, by charging the registered payment method. BikeFit-IA undertakes to send the Client a reminder email before each renewal. The Client can disable automatic renewal at any time from their personal area (see article 6); access to paid features is then maintained until the end of the current period, then suspended.
4. Pricing and Payment
4.1 Pricing
Prices are displayed in euros (EUR). VAT is not applicable (article 293 B of the French General Tax Code):
- Prices are those in effect at the time of subscription
- The Seller reserves the right to modify prices with 30 days' prior notice
- Modified prices only apply to new subscriptions or renewals
4.2 Payment terms
- Payment: Payment is made by credit card via the secure Stripe platform. The charge is processed at the time of subscription.
- Invoice: An invoice compliant with legal requirements (Seller identity, SIRET, date, service description, amount, mention 'VAT not applicable — art. 293 B of the French General Tax Code') is sent by email after each payment.
- VAT: VAT is not applicable (article 293 B of the French General Tax Code).
- Payment failure: In the event of a payment failure, the Client will be notified by email. Access to the Services may be suspended after 3 unsuccessful attempts.
4.3 Payment security
Payments are secured through the Stripe platform:
- End-to-end SSL/TLS encryption
- PCI DSS Level 1 compliance (Stripe)
- The Seller does not store any credit card data — processing is entirely handled by Stripe
5. Delivery and Performance
5.1 Nature of the service
BikeFit IA is a digital service accessible online. Access to the Services is immediate after payment validation, with no physical delivery.
5.2 Availability
- Availability target: The Seller strives to maintain the service available 24/7, with an availability target of 99%.
- Maintenance: Temporary interruptions may occur for maintenance, updates, or service improvements. The Client will be informed whenever possible.
- Technical support: Support is available by email at contact@bikefit-ia.com (response time: 72 business hours) or by phone at +33 6 99 12 61 36 (Mondays 8am–10am CET, excluding public holidays).
6. Termination and Refund
6.1 Termination by the Client
- Cancellation method: The Client may cancel their subscription at any time from their personal space (Profile → Manage subscription → Cancel), in a maximum of three clicks in accordance with the French law of 16 August 2022, or by email to contact@bikefit-ia.com.
- Effect of cancellation: Cancellation takes effect at the end of the current subscription period. No pro-rata refund will be applied.
- Post-cancellation access: The Client retains access to the Services until the end of the paid period.
- Data: After cancellation, the Client's account reverts to the free plan. Their analysis history (results, joint angles, skeleton videos) is retained, but viewing and exporting it are reserved for Clients with an active subscription. The Client has 90 days from the cancellation date to resubscribe and restore full access to their history, with no data loss; after that period, the history is automatically and permanently deleted. The Client remains in control of their data: they can delete individual analyses or their entire account at any time, directly from their personal area, in accordance with the Privacy Policy.
6.2 Right of withdrawal
In accordance with article L. 221-18 of the French Consumer Code, the Client has in principle a period of fourteen (14) days from the conclusion of the contract to exercise their right of withdrawal, without having to justify their decision. However, in accordance with article L. 221-28, 13° of the French Consumer Code, this right cannot be exercised for contracts for the supply of digital content not provided on a tangible medium whose performance has begun with the prior express consent of the consumer and after the consumer has expressly waived their right of withdrawal. Upon subscribing, the Client ticks a box confirming that they consent to the immediate performance of the Service and expressly waive their right of withdrawal.
6.3 Refund
Refunds are granted in the following cases:
- Prolonged service unavailability (more than 72 consecutive hours) without prior notice — in the form of a subscription extension or pro-rata service credit
- Confirmed billing error
- Cases provided for by applicable law
- Proven hidden defect rendering the Service unfit for its intended use
7. Obligations and Liability
7.1 Seller's obligations
- Provide the Services in accordance with these General Terms of Sale
- Maintain the security and confidentiality of Client data
- Inform the Client of any significant changes to the Services
- Provide technical support within reasonable timeframes
7.2 Client's obligations
- Use the Services in compliance with the Terms of Use and applicable laws
- Not share login credentials with third parties
- Not attempt to circumvent the service's security measures
- Provide accurate and up-to-date information
7.3 Limitation of liability
BikeFit IA provides analyses and recommendations for informational purposes only. The results do not replace the advice of a professional bike fitter or healthcare professional. The Seller shall not be held liable for damages resulting from the use or inability to use the Services. This limitation does not apply in cases of gross negligence, fraud, or failure to comply with mandatory legal obligations of the Seller. The total liability of the Seller is, all causes combined, limited to the amounts actually paid by the Client during the last 12 months.

9. Intellectual Property
All elements of the BikeFit IA service are protected by intellectual property law:
- The analysis algorithms, AI models, and source code are the exclusive property of the Seller
- Generated reports may be freely used by the Client for personal use
- Commercial reproduction or redistribution of reports or the service is prohibited without written authorization
- Uploaded videos remain the property of the Client and are automatically deleted within a maximum of five (5) minutes after processing is complete, in accordance with the Privacy Policy
- Pose analysis data (joint angles, skeleton positions) derived from the Client's videos are accessible by the Client in their personal space. Anonymized and aggregated data may be used by the Seller for service improvement purposes, in accordance with the Privacy Policy.
The subscription grants the Client a personal, non-exclusive, and non-transferable right to use the Services.
10. Force Majeure
The Seller shall not be held liable in cases of force majeure, including but not limited to:
- Natural disasters, pandemics
- Internet infrastructure or hosting provider outages
- Cyberattacks of exceptional magnitude
- Government or regulatory decisions affecting the service
- Any unforeseeable, irresistible, and external event beyond the parties' control
11. Applicable Law and Jurisdiction
- Applicable law: These General Terms of Sale are governed by French law.
- Language: These General Terms of Sale are available in several languages. In the event of a discrepancy between language versions, the French version shall prevail.
- Mediation: In the event of a dispute, the Client may use the free consumer mediation service (articles L. 611-1 et seq. of the French Consumer Code). The competent mediator is: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris (https://www.cm2c.net — litiges@cm2c.net). The Client may also consult the EU directory of dispute resolution bodies: https://consumer-redress.ec.europa.eu/dispute-resolution-bodies_en.
- Jurisdiction: Failing amicable resolution, the competent courts shall be those of the defendant's place of residence or, at the consumer claimant's choice, those of the consumer's place of residence at the time of the conclusion of the contract (article R. 631-3 of the French Code of Civil Procedure).
- Territorial limitation: The Service is intended for users residing in the European Economic Area (EEA) and Switzerland. The Publisher does not actively market the Service in the United States or Canada. Users accessing the Service from these territories do so on their own initiative. The Publisher does not guarantee the compliance of the Service with the regulations applicable in these countries and disclaims any liability resulting from use that does not conform to the geographic destination of the Service.
12. Legal Notices
The Seller reserves the right to modify these GTS. Any modification will be published on this page with the update date. In the event of a substantial modification (prices, rights, cancellation terms), the Client will be informed by email at least 30 days before the effective date. The Client who does not accept the new GTS may cancel their subscription before their effective date.
